Cyberbullying in the workplace in teleworking: an analysis from the ecuadorian legal system

Abstract

Teleworking has transformed the work environment, expanding opportunities for flexibility but also introducing new challenges, such as cyberbullying in the workplace. In Ecuador, the legal system is still in the process of adapting to face these new risks in the digital environment, and cyberbullying at work raises questions about the adequacy of existing regulations and the need for a specific legal framework, to analyze cyberbullying in telework and its regulation in the Ecuadorian legal system in order to propose regulatory improvements and protect teleworkers. The methodology used in this study is based on a systematic review of the literature, complemented with a qualitative and descriptive analysis. The PRISMA model was used for the correct elaboration and selection of articles. Telework poses challenges ranging from digital disconnection to physical and mental health protection and cyberbullying prevention. In conclusion, the transition to telework has brought with it profound transformations in labor dynamics, posing new challenges in the protection of rights, occupational health and digital safety of teleworkers.
